The portal shows case numbers, filing dates, party names, hearing dates, and status codes. It does not show the full text of decrees or any filed documents. For copies of actual documents, contact the Stafford Circuit Court Clerk directly.

The Online Case Information System statewide search pulls data from multiple court levels at once and is useful when a Stafford dissolution case has related proceedings in another court, such as a protective order or a companion criminal matter.

The Virginia Courts website explains how to go about requesting public records from clerks of court. Stafford divorce records are generally public under Titles 16.1 and 17.1 of the Code of Virginia unless a court order restricts access to a specific file.

Cases filed before the court began using its electronic system may not appear online. If that is the case, contact the clerk directly; older records may be on microfilm or in archived paper files.

Stafford County Vital Records

The Virginia Department of Health Office of Vital Records keeps a statewide divorce index, including events from Stafford County. VDH issues verification letters that confirm the fact of a dissolution, the names of the parties, and the date and place the divorce was granted. These letters are often enough for legal uses like remarriage or a name change.

VDH does not hold copies of court decrees or filed documents. For those, contact the Stafford Circuit Court Clerk. VDH records are private for 25 years after the divorce date; after that window, anyone may request them. During the 25-year period, only the parties, their immediate family, or authorized legal representatives may get copies.

Apply online or mail requests to: 8701 Park Central Drive, Suite 100, Richmond, VA 23227. The fee is $12 per copy. Call the customer care center at (804) 662-6200, Monday through Friday, 8:00 AM to 4:30 PM. If the exact divorce date is not known, VDH will search a five-year window for an added fee. Express processing is available for urgent requests.

Virginia Law and Stafford County Dissolutions

All Stafford County dissolution of marriage proceedings follow Virginia statewide statutes. Under Virginia Code Section 20-96, circuit courts have exclusive jurisdiction over divorce, annulment, and affirmation of marriage. Every dissolution in Stafford must be filed in the Stafford Circuit Court.

The grounds for divorce are in Code Section 20-91. Fault grounds include adultery, cruelty, desertion, and felony conviction. No-fault divorce requires the parties to live separate and apart for one year. With a written separation agreement and no minor children, the period drops to six months.

At least one party must meet the residency requirement under Code Section 20-97: six months of bona fide Virginia residence and domicile before filing. Military members stationed in Virginia for six months or more are presumed to qualify. Venue under Code Section 20-99 allows the case to be filed where the parties last lived together, where the defendant lives, or where the plaintiff lives if the defendant is a nonresident.

Section 20-121.4 lets a spouse request a name restoration in the divorce decree. That change takes effect when the Stafford Circuit Court enters the final order.

What Stafford County Dissolution Records Include

The official case file at the Stafford Circuit Court Clerk includes every document filed in a dissolution proceeding. This covers the complaint, responsive pleadings, motions, orders, any settlement agreement, and the final divorce decree. These files are open to public inspection unless a court order seals them.

One portion of the file is private. Under Virginia Code Section 20-121.03, Social Security numbers, driver's license numbers, dates of birth, and financial account numbers must go into a confidential addendum filed separately from the public decree. The Stafford clerk stores this addendum securely and cannot share it with the public. Access is limited to the parties, their attorneys, and authorized government agencies.

A copy of a decree from the Stafford clerk will not include the protected identifiers. For most legal purposes, the public decree is sufficient. If sensitive data was placed in the wrong section of the file, a motion to the court is required to correct it.

Land records at the Stafford clerk's office may hold deeds tied to a dissolution proceeding. If a property settlement was part of the divorce, quitclaim deeds or conveyance instruments related to that transfer should appear in the land records. The Secure Remote Access to Land Records system lets registered users search these records remotely if Stafford participates. Call the clerk's office for registration information.
