Pittsylvania County Dissolution Laws

All dissolution of marriage cases in Pittsylvania County are governed by Virginia statute. Code Section 20-96 gives Virginia circuit courts exclusive jurisdiction over divorce, annulment, and affirmation of marriage. Every Pittsylvania case must be filed with the Pittsylvania Circuit Court in Chatham.

The grounds for divorce appear in Code Section 20-91. Fault grounds include adultery, cruelty, willful desertion, and felony conviction with imprisonment. For a no-fault divorce, the parties must live separate and apart for one full year. If they have a written separation agreement and no minor children, six months of separation is enough.

At least one party must have lived in Virginia as a bona fide resident for six months before filing under Code Section 20-97. Military members stationed in Virginia for at least six months are presumed to meet this residency standard.

Privacy protections under Section 20-121.03 require that Social Security numbers, financial account numbers, driver's license numbers, and dates of birth be placed in a confidential addendum filed separately from the public decree. The Pittsylvania clerk maintains this addendum under restricted access.

What Pittsylvania Dissolution Records Contain

The Pittsylvania Circuit Court Clerk's case file includes every document filed during the dissolution: the complaint, responsive pleadings, motions, temporary orders, property settlement agreements, and the final divorce decree. These records are open to the public unless restricted by court order.

The confidential addendum required by Section 20-121.03 is filed separately and is not part of the public record. Only the parties, their attorneys, and authorized agencies may access it. The copy of a decree you receive from the Pittsylvania clerk will not include the protected identifiers in the addendum.

For most standard legal purposes, the public copy of the decree is enough. Remarriage, name changes on official documents, and passport applications typically need only the public decree. If protected data was placed in the wrong section of the public file, a motion to correct the record must be filed with the Pittsylvania Circuit Court.

Property transfers that occurred as part of a Pittsylvania County divorce settlement will be in the court's land records. Quitclaim deeds and deeds of conveyance tied to a property division are recorded there. The Secure Remote Access to Land Records system may let registered users search these records online if Pittsylvania participates. Contact the clerk's office to ask about access options and registration requirements.
