When you visit or write to the clerk, have both parties' full legal names, the approximate date of the divorce, and the case number if you know it. This helps the staff locate the record quickly. In-person requests are processed faster than mail requests, especially for older files that may need retrieval. The clerk may also offer notary services for affidavits and related documents.

You can visit the Nelson Circuit Court page on the Virginia Courts website for current hours and any policy changes. Note: Cash transactions must be completed before 4:15 PM, and land record recordings are accepted from 8:00 AM to 4:00 PM.

The Virginia Judicial System's Circuit Court Case Information portal (CJISWeb) lets you search for civil cases filed in Nelson County from any internet browser. You can search by party name, case number, or hearing date. The system shows basic case details like filing dates, party names, hearing schedules, and case status codes such as "Decreed" or "Dismissed."

This tool is free to use. No account is needed. Keep in mind that CJISWeb shows case status only. It does not display the actual text of divorce decrees or court orders. If the court does not participate in the online portal, or if the case was filed before the county joined the electronic system, you will need to contact the clerk directly. Older records may exist only in paper form at the courthouse.

The OCIS Statewide Search is another free tool that searches across multiple court levels at once, including district courts and some circuit courts. This is useful when you're not sure which court holds a related case, or when a domestic relations matter has associated criminal charges or protective orders in another jurisdiction. Note: neither system accepts payments or provides document downloads.

The Virginia Courts website also has a guide on requesting public records from clerks of court, which explains how access to circuit court case files works under Virginia law.

Certified Copies from Virginia Department of Health

The Virginia Department of Health Office of Vital Records maintains a separate statewide repository of divorce records. This office can provide verification letters confirming that a dissolution of marriage occurred in Nelson County, along with the names of the parties, the date, and the location. The copy fee is $12 per record.

VDH vital records are restricted for 25 years from the date of the event. During this period, only the parties to the dissolution, their immediate family members, or legal representatives with proper documentation may request records. After 25 years, records become public and anyone may request them without proving a relationship. This makes VDH records especially useful for genealogy research involving older Nelson County divorce cases.

You can apply online through the VDH vital records application portal. Mail requests and in-person drop-offs at the Richmond office are also accepted. Drop-offs must be submitted by 2:00 PM. The office is at 8701 Park Central Drive, Suite 100, Richmond, VA 23227. Call (804) 662-6200 Monday through Friday, 8:00 AM to 4:30 PM, with questions. Express processing is available for an extra fee.

Nelson County Dissolution Of Marriage Laws

All dissolution of marriage cases in Nelson County are governed by Title 20, Chapter 6 of the Code of Virginia. Under Virginia Code Section 20-96, circuit courts have exclusive jurisdiction over divorce, annulment, and marriage dissolution proceedings. This means the Nelson County Circuit Court is the only court that can grant a dissolution of marriage in the county.

Before filing in Nelson County, at least one party must meet the residency requirement. Section 20-97 requires that a party be a bona fide resident and domiciliary of Virginia for at least six months before the suit is filed. Members of the armed forces stationed in Virginia for six months or more are presumed to meet this requirement.

For no-fault divorce under Virginia Code Section 20-91, the parties must have lived separate and apart without cohabitation for one full year. If both parties have signed a separation agreement and there are no minor children, this period can be reduced to six months. Fault-based grounds include adultery, cruelty, desertion, and felony conviction. Section 20-99 governs venue, allowing the suit to be filed where the parties last lived together, where the defendant lives, or where the plaintiff lives if the defendant is a non-resident.

Courts in Nelson County may issue temporary orders for spousal support and child custody while the case is pending, as authorized under Section 20-103. Post-decree modifications for support can be requested when circumstances change materially.

Nelson County Dissolution Records Contents and Access

A dissolution of marriage file at the Nelson Circuit Court Clerk's Office contains all documents filed during the case. This typically includes the original complaint, any responsive pleadings, motions and orders entered during the case, a final decree of divorce, and any post-decree orders for modifications. The file is generally open to public inspection during regular business hours, but certain portions are protected.

Under Virginia Code Section 20-121.03, a confidential addendum must be filed separately from the public decree. This addendum holds sensitive personal identifiers such as Social Security numbers, driver's license numbers, dates of birth, and financial account numbers. When you get a copy of the decree from the clerk, the protected information will not appear in the public version. Only the parties, their attorneys, and authorized agencies can access the addendum.

If you need records for official purposes such as changing your name on a passport or remarrying, the public decree is generally sufficient. For parties who discover that confidential information was included in the public decree by mistake, a motion to the court can address the issue. The clerk's office handles the physical separation of these documents and is responsible for keeping them secure.

Property records linked to divorce settlements, including quitclaim deeds and conveyances, may be accessible through the Virginia Secure Remote Access to Land Records (RISWeb) system if the Nelson Circuit Court participates. Contact the clerk to ask about registration and any subscription fees.
