Dissolution of Marriage Laws in Henrico County

Virginia law governs all dissolution of marriage cases in Henrico County. Under Virginia Code Section 20-96, circuit courts have exclusive jurisdiction over divorce and annulment. All dissolution cases for Henrico must be filed at the Henrico Circuit Court.

The grounds for divorce are set out in Code Section 20-91. These include fault grounds such as adultery, cruelty, desertion, and felony conviction, plus no-fault grounds based on separation. Under Section 20-121.03, identifying information such as Social Security numbers must be placed in a confidential addendum kept separate from the public record.

What Henrico Dissolution Records Contain

One part of the file is not public. Virginia Code Section 20-121.03 requires that all identifying data, including Social Security numbers, driver's license numbers, dates of birth, and financial account numbers, be placed in a confidential addendum filed separately from the public decree. The Henrico Circuit Court Clerk stores this addendum securely. Only the parties, their attorneys, and certain government agencies may see it.

When you get a copy of a divorce decree from the Henrico clerk, the copy will not include anything from the confidential addendum. For common legal uses such as a name change, passport application, or remarriage, the public decree is generally enough. If sensitive data ended up in the public portion by mistake, a motion must be filed to correct the record.
